Petitioner seeks bail in a case registered under section 414 of the Indian Penal Code and 25(1-B) a/ 26/35 of the Arms Act.

The prosecution story in brief is that the O/C of Barari P.S. along with some police personnel had gone to investigation in course of investigation they reached at Mansahi P.S., where they along with the O/C Mansahi P.S. proceeded from there with the purpose to arrest the accused Lal Jha who was wanted in Barari P.S. Case no. 49 of 2015 and thereafter caught hold him along with the accused petitioner when they arrived on a pulsar Motorcycle and after chase they have been arrested by the

Patna High Court Cr.Misc. No.22135 of 2015 (2) dt.16-07-2015 2/2 police party and after search a loaded country made pistol has been recovered from the possession of the Lal Jha and in possession of the petitioner a live cartridge has been recovered from the back pocket of his jeans.

On behalf of the petitioner it has been submitted that petitioner is in custody since 14.3.2015 and charge sheet has been submitted in the case. Further it is submitted that from the possession of the petitioner one live cartridge has been recovered. On behalf of the State it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri Sunil Kumar -III, J.M. Ist Class, Katihar in Barari (Semapur) P.S. Case No. 50 of 2015. (Sudhir Singh, J) M.Rahman/- U T
