JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending her arrest in connection with Revilganj P.S. Case No. 137 of 2014 for the offences instituted under Sections 420, 467, 468 and 471 of the IPC. The prosecution story, in brief, is that the petitioner has been appointed as A.N.M. in the Primary Health Centre, Rivelganj, Saran at Chapra, on the basis of forged certificates. It is further alleged that the petitioner has not received any salary during her service period.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is said to have joined the said service in

Patna High Court Cr.Misc. No.26624 of 2015 (3) dt.23-09-2015 2/2 question on 11.03.2014 and she was in service till 03.12.2014 but she had not withdrawn even a single farthing against her salary. Hence, she has not caused any wrongful loss to the State. It is further submitted that the petitioner is a lady. On behalf of the State it has been submitted that the certificate on the basis of which the petitioner had sought for her appointment is found to be a fake.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of four weeks from today in connection with Revilganj P.S. Case No. 137/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
