The petitioner apprehends his arrest in Benipatti P.S. case No. 153 of 2015 under Section 454, 456, 380 and other Sections of the Indian Penal Code.
The informant alleged that petitioner developed good relation with the informant and he used to come to the house of informant. The informant further alleged that in the night of 16/17.08.2015 the petitioner with his two friends entered into the house and committed theft of ornaments and cash after threatening the informant.
The learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. The informant herself disclosed that she had good relation with the petitioner but
Patna High Court Cr.Misc. No.17222 of 2017 (4) dt.06-07-2017 2/2 it appears that petitioner left his mobile in the house of informant. The informant made specific allegation that petitioner committed theft of ornaments and cash.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this court.
