JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Medni Choki P.S. Case No. 09 of 2015 for the offence punishable under section 379 of the I.P.C.

Allegedly, tailor of tractor of the informant was stolen away in the night and the informant suspected hands of the FIR named accused persons. During investigation the tailor was recovered from the paint's shop of Krishnandan Kumar where the petitioner has kept the same as per the statement given by Krishnandan Kumar under section 164 of the Cr.P.C. Submission is of false implication and that the

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances as stated above, considering the aforesaid material against the petitioner, I am not inclined to grant privilege of pre-arrest bail to him and accordingly as his such prayer stands rejected in connection with the aforementioned case pending in the court of A.C.J.M.
