1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

3. The learned counsel for the petitioner, at the outset, submits that Md. Shamsher Ali and Md. Shahid Khan had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 6015 of 2024 and Criminal Miscellaneous No. 21394 of 2024 respectively. It is next submitted that both were granted the privilege of anticipatory

Patna High Court CR. MISC. No.64771 of 2024(2) dt.10-01-2025 2/3 bail and the case of the instant petitioner is also akin to their cases.

The learned counsel appearing on behalf of the informant does not dispute the said submission of the learned counsel appearing on behalf of the petitioner, but then submits that since based on instruction of Md. Shamsher Ali and Md. Shahid Khan, a submission was made in their cases that they will not lay claim over the land in question, as such, their anticipatory bail was not opposed, on which the learned counsel appearing on behalf of the petitioner submits that the instant petitioner would also not lay claim over the land in question as the sale deed was executed by a fictitious person and will recover the amount which he had paid to the person who got the sale deed executed in his favour by impersonating the father of the informant.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is

Patna High Court CR. MISC. No.64771 of 2024(2) dt.10-01-2025 3/3 pending/successor court in connection with Gandhi Maidan P.S. Case No. 628 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. Accordingly, the instant anticipatory bail application is allowed.
