JUSTICE SUDHIR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 324, 326, 307 and 504 of the Indian Penal Code.
Allegation against the petitioner is that he on account of old enmity abused informant and gave repeated knife blows on the left portion of his nose.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. The petitioner has falsely been implicated due to previous enmity. As per the allegation, petitioner is said to have given knife blow on the face of the informant. From perusal of the injury report it is evident that there is no sharp cutting injury rather the injury is a lacerated wound. Hence, the injury report does not support the allegation made in the F.I.R. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on
Patna High Court Cr.Misc. No.8495 of 2016 (3) dt.28-03-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Ist Addl. Chief Judicial Magistrate, Purnea, in connection with Sadar (Muffasil) P.S. Case no. 480 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
