The petitioner seeks bail in a case under section 386, 379 and 307 of the Indian Penal Code and section 25(1-b)a, 26, 27 and 35 of the Arms Act.

The informant alleged that three persons came on a motor cycle and asked the informant to give petrol. The informant alleged that the petitioner without paying the price thereof wanted to flee away. When the money was demanded, the driver of the motor cycle opened fire and tried to flee away. The petitioner was a pillion rider. Another pillion rider Pawan Kumar has been enlarged on bail by order dated 30.04.2015 vide Criminal Misc. No. 17123 of 2015.

Considering the facts aforesaid, the petitioner

Patna High Court Cr.Misc. No.23593 of 2015 (2) dt.09-07-2015 above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Judicial Magistrate, 1st Class, Jhanjharpur in connection with Khutauna P.S. Case No. 88 of 2014.
