2. Learned counsel for the petitioner has submitted that though earlier the regular bail petition of the petitioner was rejected vide order dated 21.04.2023 in Cr. Misc No. 71669 of 2022, but he is renewing the prayer for bail on the fresh ground that not a single witness has been examined up-till now after framing of the charge, i.e., 19.04.2023. In this respect, a report was called for from the court below. The report has been received through letter No. 185/2023 dated 08.11.2023 which shows that charge was framed on 19.04.2023 and the case is pending at the stage of prosecution evidence. Summons to the witnesses were issued on 26.06.2023 against prosecution
Patna High Court CR. MISC. No.63843 of 2023(3) dt.01-12-2023 2/2 witnesses, but not a single witness has been examined as yet. He has submitted further that on similar footing co-accused Manish Kumar has been granted bail by a coordinate Bench of this Court.
3. The learned trial court is directed to expedite the matter and do not fix a date for more than a week. He shall take every endeavour to dispose of the trial within a period of four months. If the trial is not concluded within the stipulated period, the petitioner may renew his prayer for bail before the learned court below itself.
4. With these observations, the regular bail petition is disposed of.
