This application for anticipatory bail arises out of Garkha P.S. Case N0. 59 of 2006, disclosing offences under Sections 366A, 372 and 120B of the Indian Penal Code and. Since the minor girl who is said to be below 11 years has not been recovered so far, I am not inclined to grant anticipatory bail to the petitioner, considering gravity of the offence.

This application is accordingly rejected.

The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
