The petitioner is apprehending her arrest in a case registered under sections 304(B), 201 and 34 of the Indian penal Code.
According to the first information report the sister of the informant was killed by strangulating her by his brother-in-law and disposed of the dead body. On behalf of the petitioner it is submitted that the petitioner has got not criminal antecedent. Petitioner has been made accused due to mistake of fact. The petitioner is married Nanad of the deceased and there is no specific allegation against her.
Patna High Court Cr.Misc. No.24125 of 2015 (3) dt.03-09-2015 2/2 On behalf of the State and the counsel for the informant it has been submitted that the petitioners is named in the first information report.
Considering the aforesaid facts and circumstances, the above named petitioner in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Syed Qamrul Hasan Rizvi, J.M. Ist Class, Gaya in Main ( Paibigha O.P) P.S. Case no. 04 of 2015, subject to the conditions as laid down under section 438(2) Cr.P.C. (Sudhir Singh, J) M.Rahman/- U T
