2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 409, 406, 420/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner received Rs.12.90 lacs for execution of work under Nal Jal Scheme but completed the work to the tune of Rs. 6.06 lacs and thus petitioner defalcated Rs.6.83 lacs.

4. Learned counsel appearing for the petitioner submits that the informant has filed counter affidavit stating therein that remaining work has also been completed by the petitioner during pendency of this bail petition as per report of the Panchayat Secretary (annexure R/A to the counter affidavit). Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer

Patna High Court CR. MISC. No.70973 of 2024(5) dt.13-02-2025 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Bhojpur at Ara in Shahpur Police Station Case No. 335/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
