The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 472/34 of the Indian Penal Code. The prosecution case is that the informant Deepak Kumar being the Branch Manager of Bank of India, Transport Nagar Branch alleged that on 15.09.2015 a cheque worth Rs.1,74,500/- was deposited by co-accused Madhukendra Kumar in his saving bank account which is found to be fake cheque.

Subsequently, co-accused Madhukendra Kuamr suggested to the informant that the said cheque was given to him by the petitioner.

No.9538 of 2016 (2) dt.01-03-2016 2/2 It is submitted by learned counsel for the petitioner that admittedly the cheque was deposited by coaccused Madhukendra Kumar in his account and the cheque was issued by Vinay Prasad Sao. Hence, no case is made out against the petitioner.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Agamkuan P.S. Case No. 415 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
