In this case, the petitioner is apprehending his arrest in connection with Ara Rail P.S. Case No. 37 of 2017 registered for offences under sections 147, 341, 323, 332, 330, 337, 342, 307, 353, 427/120B of the Indian Penal Code and Section 145, 146, 147, 156, 174(A) of the Railway Act.
An allegation has been made that the students of the Petitioner, who runs a Coaching Center, started demonstration by raising an anti government slogan, whereafter, they have entered into the enquiry office, resorted vandalism, caused obstruction in the movement of the train and also caused damage to the property of the Railway and some of the passengers also received several
Patna High Court Cr.Misc. No.33763 of 2017 (2) dt.27-07-2017 injuries on their person. Fans of the A.C. Coach were also broken by pelting of bricks and stones, thereby, caused heavy loss to the Railway. The passengers of Archana Express also received several injuries.
Learned counsel for the petitioner submits that the petitioner is the owner of the Coaching Center and has nothing to do with the vandalism caused by the students. The petitioner was also not there at the place of occurrence.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Saurav Srivastava @ Saurav Kumar Srivastava @ Saurabh Kumar Srivastava @ Saurabh Srivastava, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Ara in connection with Ara Rail P.S. Case No. 37 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
