JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2017 The appellants seek pre arrest bail in connection with Bhojpur SC/ST P.S. Case No. 07 of 2016, registered for the offences punishable under sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and Section 3(i)(vi)(x) of the SC/ST (Prevention of Atrocities) Act.

Allegation against the petitioner is that when he went to demand the due wages, he has been abused by the appellant by taking caste name.

Submission of learned counsel for the appellant is that there is delay of 11 days in lodging the compliant petition. Heard learned Special P.P. also.

Having heard both sides, in view of the facts and circumstances stated above, this appeal is not maintainable. I am

Patna High Court CR. APP (SJ) No.1479 of 2017 (3) dt.18-07-2017 not inclined to grant privilege of pre arrest bail to the appellant. The appellant may surrender before the Special Court and make prayer for regular bail, and if any such application is filed, the learned Special Judge shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.

With the above observation, this appeal is disposed of accordingly.
