1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 406, 409 and 120(B) of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant with an allegation that the informant had deposited an amount of Rs.1,20,000/- in the committee which the petitioner along with others had opened but when she demanded her money back the same was not returned along with interest. Learned counsel next submits that the dispute in between the petitioner and the informant stands settled for which a compromise petition has also been filed before the learned trial court.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that if the petitioner after getting anticipatory bail does not honour the settlement then what will happen.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Hathauri P.S. Case No. 276 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. However, the informant shall be at liberty to file an application seeking cancellation of the anticipatory bail granted to the petitioner if the compromise entered in between the petitioner and the informant is not honoured by the petitioner. (Satyavrat Verma, J) Kundan/- U T
