2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Mashrak P.S. Case No. 408 of 2020 registered for the offence under Sections 147, 148, 149, 188, 341, 323, 307, 324, 325, 504 and 506 of the Indian Penal Code and later Section 302 was also added.

4. As per the prosecution case, the petitioner is accused of killing the deceased with other accused persons.

5. Learned counsel for the petitioner submits that the petitioner has committed no offence and other co-accused

Patna High Court CR. MISC. No.64443 of 2023(2) dt.11-10-2023 2/2 persons have already been granted bail vide order dated 23.12.2020 passed in Cr. Misc. No. 35227 of 2020.

6. Learned counsel for the petitioner also submits that the petitioner is in custody since 29.05.2023.

7. Learned A.P.P. has vehemently opposed the prayer for bail.

8. Considering the aforesaid facts and the period of custody and also for the reasons mentioned in the order dated 23.12.2020 passed in Cr. Misc. No. 35227 of 2020, this application for regular bail is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chhapra in connection with Mashrak P.S.
