The petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
The petitioner is in custody since 17.03.2018. The petitioner is husband of the victim of dowry death. Marriage was solemnized in the year 2010. The victim was mother of two children aged about 5 years and two years and she was pregnant as well at the time of death. Allegation is of demand of dowry and torture for the same.
Submission is that after cremation of the dead body
Patna High Court CR. MISC. No.80236 of 2018(3) dt.16-04-2019 2/2 the case was lodged just to harass the petitioner. Learned counsel for the informant opposed the prayer for bail.
Considering the fact that there is no direct evidence against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sathi P.S. Case No.29 of 2018, with condition that petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
