2. The petitioners apprehend their arrest in connection with Gautam Budh Nagar P.S. Case no.214 of 2025 registered under Sections 126(2), 191(2), 115(2), 118, 117(2), 109, 352, 351(2), 303(2) and 3(5) of the B.N.S, 2023.
3. The allegations in the F.I.R is that accused persons, being ten in number, attacked the informant with weapons on account of a dispute with regard to partition causing injuries to the informant and his family members.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No. 62542 of 2025(2) dt.15-09-2025 2/3 petitioners have been falsely implicated in the case. Both the parties are the agnates and because of land dispute, the alleged occurrence has taken place. There is case and counter case. The manner of occurrence is other than what has been narrated in the F.I.R and the correct version is stated in the F.I.R. being Gautam Budh Nagar P.S. Case no.215 of 2025 lodged by the petitioners' side against the informant and his family. There is general and omnibus allegation levelled against the petitioners. Learned counsel for the petitioners in reference to the order of rejection the learned Court below submits that the injuries suffered by the informant and her family members are found to be simple in nature caused by hard and blunt object. The petitioners have no criminal antecedent and undertake to cooperate in the case/trial.
7. The application for anticipatory bail is opposed by learned A.P.P. for the State.
8. Taking into consideration that fact that there is general and omnibus allegation levelled against them, there is case and counter case and also considering the fact that injuries suffered by the informant is simple in nature, it is directed that the petitioners above named, having no criminal antecedent in the event of their arrest or surrender before the learned Court
Patna High Court CR. MISC. No. 62542 of 2025(2) dt.15-09-2025 3/3 below within a period of four weeks, be released on anticipatory bail in connection with Gautam Budh Nagar P.S. Case no.214 of 2025 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
