The petitioner apprehends his arrest in Rajapakar (Barati O.P.) P.S. Case No. 14 of 2017 registered for the offences punishable under Sections 379 and 34 of the Indian Penal Code. The informant alleged that Ratnesh Kumar, the driver of Piaggio tempo bearing Registration No. BR-31-GA-4005 was going to Darbhanga loaded with chick. Ratnesh Kumar stopped his vehicle to urinate by the side of the road the petitioner came with other persons on a whit Maruti car and fled away with the vehicle loaded with chicken of the informant. Learned counsel for the petitioner submits that the petitioner and the informant were working in a hatchery. On account of some business rivalry the petitioner has falsely been

Patna High Court Cr.Misc. No.19654 of 2017 (2) dt.06-07-2017 2/2 implicated in the case but it appears that the informant has very clearly stated that it was the petitioner who came along with other accused persons on a white coloured Maruti car and fled away with the vehicle loaded with chicken.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
