The petitioner seeks regular bail in connection with Phesar P.S. Case No. 49 of 2018, registered for the offence punishable under Sections 420, 409, 34 of the Indian Penal Code.

Allegation against the petitioner, the Manager of PACS and Chairman of PACS for not depositing the C.M.R. equivalent to given paddy worth Rs. 26,18,227, 59/- and thus causing loss to the state exchequer.

Learned counsel for the petitioner submits that it is the duty of miller to supply the CMR and not of the petitioner. He is in custody since 06.07.2019.

No. 58372 of 2019(3) dt.06-02-2020 2/2 Learned counsel for the B.S.F.C. opposed the prayer for bail on the ground that the petitioner along with the Chairman are responsible for collecting the C.M.R. but they have not collected the same not import the authorities concerned, causing and they would not deposit the C.M.R. to causing loss of revenue to the tune of Rs. 26,18,227, 59/- Considering the submissions, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.
