JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 376/511 and 354B of the Indian Penal Code and sections 8 and 10 of the Protection of Children from Sexual Offences Act. The prosecution case is that seven-years-old-daughter of the informant went to school but while coming back home, she fell into a ditch. The petitioner being neighbour took her out from the ditch and took her to Anganbari Centre and tried to undress her.

It is submitted by the learned counsel for the petitioner that the petitioner is neighbour of the informant and is an old person and due to dispute the accusation has been levelled. It is

No.23329 of 2015 (2) dt.25-06-2015 2/2 further submitted that on the alleged date of occurrence there was vaccination program at the Anganbari centre but none at the centre disclosed that the petitioner took the victim to Anganbari centre. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Special Case No. 46 of 2014 arising out of Bhawanipur (Akbarpur) P.S. Case No.263 of 2014 pending in the court of learned 1st Additional Sessions Judge cum Special Judge, Purnea.

This application is disposed of with the aforesaid observation/direction.
