The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 302, 427, 120B of the Indian Penal Code and section 27 of the Arms Act and Section 3⁄4 of the Explosive Substance Act. As per allegation in the FIR, accused persons including the petitioner attacked the Scorpio vehicle and hurled bomb on the vehicle and killed Rajesh Yadav and Manoj Yadav by making firing. It has also been alleged that the culprits attacked the Scorpio vehicle under impression that the informant was traveling in the vehicle.
It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in
Patna High Court CR. MISC. No.62022 of 2022(2) dt.21-02-2023 2/2 this case due to village politics. There is no specific overt act against the petitioner. General and omnibus allegations have been levelled against the petitioner. Co-accused Neeraj Kumar Yadav has been released on bail vide Cr. Misc. No. 49434 of 2019, as mentioned in para 9 of the petition. Petitioner is languishing in judicial custody since 31.07.2019. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ADJ IV, Jamui in connection with Jhajha P.S.
