The petitioner seeks bail in connection with Patori P.S. Case No. 449 of 2013 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Sheela Devi, the younger sister of the informant, was married to the petitioner in June, 2013 and allegedly, the petitioner having illicit relationship with his Bhaujai killed Sheela Devi after strangulating her.

Submission is of false implication and that the petitioner was having cordial relation with his wife, the wife of the petitioner only on suspicion started quarreling with the petitioner, the wife of the petitioner committed suicide due to some domestic dispute and as such the petitioner deserves sympathetic consideration as he is suffering in custody since 30.07.2015 to

Patna High Court Cr.Misc. No.10432 of 2016 (3) dt.18-04-2016 which learned APP opposes by submitting that during post mortem injury has been found on the neck and the cause of death has been found due to throttling and the witnesses have also supported the prosecution version.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner serious in nature, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected. (Jitendra Mohan Sharma, J) avin/- U T
