JUSTICE RAKESH KUMAR ORAL ORDER 06-07-2017 Heard Sri Virendra Kuar, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in Khusropur P.S. Case No. 21 of 2017 , registered for the offence under Section 420, 120B of the Indian Penal Code, Section 30(a), 38, 41 of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail in event of arrest or surrender. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case. He submits that on National Highway two vehicles were intercepted and six persons were arrested. From the two vehicles total number of bottles of Indian make foreign liquor were recovered. He submits that petitioner's name has come on

Patna High Court Cr.Misc. No.16511 of 2017 (2) dt.06-07-2017 2/2 disclosure of some of the accused parsons . He submits that save and except the statement of the co- accused no other material has been recovered, and as such, there is no reason to refuse the prayer for anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Arjun Rai @ Arjun Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar Rai, learned Judicial Magistrate Ist Class - cum-Additional Munsif V, Patnacity / concerned court in connection with Khusropur P.S.
