JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 441, 323, 498A, 313 and 504/34 of the Indian Penal Code.
The accusations are of torture and getting the pregnancy terminated.
It is submitted by learned counsel for the petitioner that there is no medical proof with regard to termination of pregnancy and the thrust of accusation is against the husband of he informant who is ready to keep the informant as wife with full dignity and honour.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or
Patna High Court Cr.Misc. No.23795 of 2015 (2) dt.09-07-2015 2/2 surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikrahana at Motihari in connection with Rajepur P.S.
