The petitioner seeks bail in a case for the offence registered under Sections 399, 402, 414 of the IPC, 25(1-b)a, 26 and 35 of the Arms Act.

The prosecution story, in brief, is that the petitioner arrested the petitioner in routine vehicle checking work on 08.05.2019 and he was found accompanied with other four coaccused indulging to commit robbery on the road. On search, one country made pistol with two live cartridges and one mobile were recovered from possession of the petitioner. One Alto car was also recovered.

It has been submitted by learned counsel for the

Patna High Court CR. MISC. No.58547 of 2019(2) dt.17-09-2019 2/2 petitioner that the petitioner is languishing in custody since 09.05.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. One loaded country made pistol alongwith two live cartridges and one Alto car are alleged to have been recovered. The petitioner had no knowledge that the car in question is a stolen property. There is no compliance of Section 100 of Cr. P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., Barh, in connection with Mokama P.S. Case No. 89 of 2019, corresponding to G.R. No. 614 of 2019.
