JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Baisi P.S. Case No. 223 of 2016 registered for the offences punishable under Section 379 of the Indian Penal Code and Section 21 (1)(2) of the Mines and Mineral (Development & Regulation) Act.

It is stated by the learned counsel for the petitioners that the petitioners are owner of trucks on which coal was being

It is stated that so far as the allegation of carrying coal without transportation challan is concerned, the petitioners cannot be held accountable for the same as the trucks were being driven on hire and they were no present at the time of occurrence.

Be that as it may, regard being had to the nature of allegation, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Baisi P.S. Case No. 223 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender within a period of six weeks from today.
