JUSTICE S. KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the State.
Petitioners are apprehending their arrest in Patahi P.S. Case no. 66 of 2017 for the offences registered under Sections 147, 149, 341, 323, 353, 379, 504 and 506 of the Indian Penal Code.
Allegation of petitioners is that they along with other villagers entered into the electric supply office, stopped supply of electricity, assaulted the operator and disturbed functioning government work.
Patna High Court Cr.Misc. No.32018 of 2017 (2) dt.13-07-2017 2/2 It is submitted on behalf of the petitioners that they have got no criminal antecedent. Allegation against all the petitioners is general and omnibus. Actually, petitioners went to the Electricity Department to submit petition for smooth supply of electricity. They have falsely been implicated in the present case. The anticipatory bail petition has been vehemently opposed by Mr. Sanjay Giri, learned counsel appearing on behalf of opposite party no. 2.
Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari in Patahi P.S. Case no. 66 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
