2. The petitioner seeks regular bail in connection with Kutumba P.S. Case No. 108 of 2025 for the offence registered under Section 30 (a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, total 352.5 litres of illicit foreign liquor recovered from three motorcycles. It is alleged that the petitioner was apprehended on spot in possession of one of the seized motorcycles.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He has no concern with the seized liquor or motorcycle. Nothing has been recovered from the conscious possession of the petitioner. He further submits that the petitioner was neither
Patna High Court CR. MISC. No.60887 of 2025(2) dt.24-09-2025 2/2 driver nor owner of the seized motorcycles. Petitioner is in jail custody since 24.07.2025, having one criminal antecedent in which he is on bail. Petitioner undertakes to cooperate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned court/Aurangabad, in connection with Kutumba P.S.
