JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act. Two mobile sets and one motorcycle are said to have been recovered from conscious possession of the petitioner when he was caught by the police.

Contention on behalf of the petitioner is that the seized motorcycle belongs to brother of the petitioner whereas seized mobiles belong to petitioner. It is further submitted that petitioner was earlier made accused in four cases in the year 2012

Patna High Court Cr.Misc. No.11723 of 2016 (2) dt.16-03-2016 2/2 but he was granted bail in almost all the cases and again when petitioner was arrested in the present case, he was remanded by the police in three other cases. It is further submitted that moreover, having more or less similar allegation, one co-accused, Ashik Kumar @ Aashik Kumar has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 958 of 2015.
