====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners, counsel appearing on behalf of the State as well as complainant.
Patna High Court Cr.Misc. No.13942 of 2018 (2) dt.05-04-2018 2/3 The petitioners apprehend their arrest in in connection with Tr. No.3252 of 2016 arising out of Complaint Case No.399(c) of 2016 and Tr. No.3251 of 2016 arising out of Complaint Case No.400(c) of 2016 respectively, registered under Section 406 of the Indian Penal Code and 138 of Negotiable Instrument Act. The learned counsel for the petitioners submits that parties have entered into compromise. This factual position has been admitted by learned counsel for the complainant also. In view of the above and considering the nature of dispute which is commercial in nature and when the parties have entered into compromise, the Court see no reason to refuse anticipatory bail.
Let the petitioners in both the cases, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Patna in connection with Tr. No.3252 of 2016 arising out of Complaint Case No.399(c) of 2016 and Tr. No.3251 of 2016 arising out of Complaint Case No.400(c) of 2016 respectively subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
