2. Petitioners apprehends arrest in a case registered for the offences punishable under Sections 191, 190, 126(2), 109, 115(2) and 351(2) of the B.N.S. 2023.

3. The prosecution case, in brief, is that on 20.03.2025, all the F.I.R named accused persons allegedly came to the door of the informant and assaulted him. Further, it is alleged that petitioner no. 2 fired upon the informant which did not hit him. It is further alleged that the accused persons threatened the informant with dire consequences,

4. Learned counsel for the petitioners submits that the allegations are false and fabricated. There is no injury report on record to substantiate the allegations levelled against the petitioners. Both parties are gotiyas and the present case arises out of a land dispute, where an altercation took place leading to case and counter-case between the parties. The allegation of assault is general and omnibus in nature, and no one has sustained any firearm injury. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, clean antecedent, and the fact that there is no injury report on record to substantiate the allegations levelled against the petitioners, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad
