JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioners are apprehending their arrest in connection with Rasulpur PS case No. 25/2015 for the offence under section 341, 323, 504 of the Indian Penal Code and Sections 3(1) X SC/ST Act.

Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that the informant has alleged that on 19.03.2015 when she was cutting the mustered crop in her field the petitioners came and prohibited from cutting the crop claiming their own field then the informant protested on which the petitioners started abusing her by referring her caste name and brutally assaulted her by means of lathi. The petitioners caught her hair on which she fell down on earth and thereafter

Patna High Court Cr.Misc. No.23599 of 2015 (2) dt.06-07-2015 2/2 they indiscriminately assaulted her and when her husband son and other villagers came they fled away.

On behalf of the petitioners, it has been submitted that there is case and counter case. Counter case is annexure-2 to the present application. It has further been submitted that the petitioners have no criminal antecedent. It has also been submitted that provisions of SC/ST Act is not attracted as the occurrence has not taken place in public place.

On behalf of the State, it has been submitted that petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Chapra, Saran in connection with Rasulpur PS case No. 25/2015, subject to condition as laid down under section 438(2) of the Cr. P.C.
