The petitioner seeks bail in connection with Hajipur Town P. S. Case No.824 of 2020, instituted for the offences under Sections 30(A), 30(C), 38 of the Excise Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 20.07.2021, charge-sheet has been submitted in the case and has antecedent of 10 cases. Allegation is of recovery of 31.02 litre of liquor from a room of Dakbunglow Complex at Dakbunglow road, Patna. The learned counsel for the petitioner submits that petitioner was not arrested from the place of occurrence and was implicated in the case based on information provided by local

Patna High Court CR. MISC. No.72300 of 2021(2) dt.02-03-2022 2/2 people. It is submitted that the police because of his antecedent got him implicated in the present case. The learned counsel submits that charges have been framed and trial has commenced, but not a single witness has been examined. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the place of occurrence and in the nature of recovery, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Hajipur Town P. S. Case No.824 of 2020.

The application stands allowed.
