This petition has been filed for quashing the first information report of Bihariganj P.S. Case No. 19 of 2015. A report has been received from the Court below about the present stage of the case. It has been submitted in the report that on the basis of the first information report the police has already submitted charge sheet against one of the accused, namely, Bageshwar Yadav, for the offence under Sections 366A and 34 of the Indian Penal Code. The investigation against other accused persons is pending.

The cognizance for the offence under Sections 366A and 34 of the Indian Penal Code has already been taken

Patna High Court Cr.Misc. No.25042 of 2015(4) dt.26-03-2018 2/2 against accused, Baageshwar Yadav, by order, dated 06.02.2018, and records of other accused persons have been separated and pending for receipt of the final report from the police under Section 173 of the Criminal Procedure Code.

Therefore, this criminal miscellaneous petition is disposed off with direction to Superintendent of Police, Madhepura, to direct the concerned investigating officer to conclude the investigation of other accused persons in the instant case as early as possible preferably within a period of three months from the date of receipt of this order and submit the final report in the Court below in terms of Section 173 of the Criminal Procedure Code.

The District & Sessions Judge, Madhepura, will communicate this order to the Superintendent of Police, who will send compliance report to the District & Sessions Judge, Madhepura, after completion of the investigation. (Sanjay Priya, J) Shamshad/- U T
