Petitioners apprehend their arrest in Haveli Kharagpur P.S. case no. 381/2017 instituted for the offence under Section(s) 341,323,379, 338, 308 and 504 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that informant and petitioner no.2 are full brothers.

Patna High Court Cr.Misc. No.17773 of 2018(3) dt.19-04-2018 2/3 The occurrence has taken place on account of partition of the property. There has been injury from both sides. In the instant case injury sustained by the informant is simple in nature. Learned counsel for the petitioners has submitted that injury has been received by the petitioner no.2 in the counter case also which is available in para 11 of the bail petition. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Haveli Kharagpur P.S. case no. 381/2017, they shall be released on anticipatory bail on furnishing bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Munger, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Patna High Court Cr.Misc. No.17773 of 2018(3) dt.19-04-2018 3/3 prosecution will be at liberty to move for cancellation of bail of the petitioners.
