This application for anticipatory bail arises out of Chandi (Wena) P.S. Case No. 145 of 2019 for the offence punishable under Sections 341, 323, 379, 307, 504 and 506/34 of the Indian Penal Code.
The dispute between the parties is said to have arisen because the informant was protesting against use of D.J. in high pitch in a marriage function. Allegedly, aggrieved by the protest made by the informant, the accused persons assaulted him with lathi, danda and iron rod and snatched a golden chain. Learned counsel appearing on behalf of the petitioner is correct in his submission that there is no specific allegation of assault or any overt act against this petitioner. Considering the facts and circumstances and the submission so advanced, this application is allowed.

No.57569 of 2019(2) dt.13-09-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa (Nalanda) in Chandi (Wena) P.S. Case No. 145 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
