1. Heard learned counsel for the parties.
2. The petitioner has filed the instant application for grant of regular bail in connection with Mansi P.S. Case no. 140 of 2022 registered under sections 307, 341, 323, 326 and 506/34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, it is stated that the petitioner caught hold of the informant and on the orders of this petitioner, Ramen Yadav fired from his pistol hitting the informant in his stomach.
4.It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. are false and concocted. The petitioner, as per the F.I.R, is said to be the order giver and to have caught the informant. So far as the allegation of firing is concerned, the same is on Ramen Yadav. 5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the allegation of firing being on Ramen Yadav, the petitioner having remained in custody since 4.5.2023 and charge-sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Mansi P.S. Case no. 140 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIII, Khagaria.
