Mr. Madhura Nand Jha (APP-102) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-02-2018 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Kopa P.S. Case No. 145 of 2016, registered for the offences punishable under Sections 147, 148, 149, 332, 342, 353, 307, 379 and 511 of the Indian Penal Code, Section 30/37 of Bihar Excise Act and Section 27 Arms Act.

Allegedly, three persons were found taking wine by the side of the road and when the police party chased them, members of Barat party and other three persons along with 4050 members of Barat party surrounded the police force and

No.4927 of 2018(2) dt.08-02-2018 2/3 attacked on them, they threw down the Hawaladar Nand Kumar and assaulted the police party with fists and leg causing bleeding from nose and mouth of the informant. They were also making firing from the rifle. The police party informed SHO Revilganj P.S. and after arrival eight persons were apprehended. Submission is of false implication and that against the petitioners there is no specific allegation, only on suspicion the petitioners have been implicated in this case. How the names of the petitioners have been taken is not disclosed and in this case similarly situated co-accused Ajit Singh @ Ajit Kumar Singh, Jai Shankar Singh, Jai Ram Singh and Shailesh Singh @ Shailesh Kumar Singh have been allowed pre-arrest bail vide Cr. Misc. No. 10606 of 2017 by another co-ordinate Bench of this Court and, as such, the petitioners deserve sympathetic consideration.

The learned A.P.P. fairly submits that similarly situated four co-accused have been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to
