The petitioner seeks bail in anticipation of his arrest in connection with R.P.F. Post Bhagalpur P.S. Case No. 886/2017 dated 09.08.2017 instituted for the offence under Section 143 of the Railways Act, 1989.
From the F.I.R., it appears that the Internet Ticketing Anti-fraud Team of the railways, in order to check unauthorized business of procuring and supplying e-tickets, had found out that many tickets were procured from the user I.D., viz. atiqmau. The petitioner was found to be the person using the aforesaid user I.D. From the aforesaid user I.D., about 48 e-tickets are said to have been procured in the name of different persons for different trains and destinations ranging from 01.01.2017 to 09.08.2017.

No.4253 of 2018 (2) dt.01-02-2018 2/2 Learned counsel for the petitioner has submitted that he is a student and because he is Computer savvy, all his friends and relatives used to get their e-tickets booked through his I.D. He has completely denied of having charged any extra money from the persons, for whom he had booked the railway e-tickets. That apart, it has also been submitted that according to the railway rules, a person is entitled to book six e-tickets in a month.
There being no evidence of the petitioner having sold those e-tickets at an enhanced cost, Section 143 of the Railways Act, 1989 shall not be attracted.
The petitioner has clean antecedent.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Bhagalpur in connection with R.P.F. Post Bhagalpur P.S. Case No. 886/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
