JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-05-2023 The present writ petition has been filed seeking the following reliefs :- " (i) To direct the respondent authority to restore the possession of the petitioner over the land in question bearing Khata no. 277 plot no. 1102 measuring an area 171/2 Dhur situated under Bhagwanpur Anchal in the District of Begusarai.
(ii) To direct the respondent authority to ensure the fresh construction of his residential house which was demolished by the respondent authority, without adopting proper proceeding under public land encroachment act.
(iii) To direct the respondent authority to pay
Patna High Court CWJC No.15139 of 2022(2) dt.11-05-2023 2/2 heavy cost to the petitioner against the demolition of his residential house.
(iv) To take legal action against the responsible government official who illegally demolished the residential house of the petitioner. "
After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
