The petitioner apprehends his arrest in connection with Mansi P.S. Case no. 147 of 2016, registered under Section 364/34 of the Indian Penal Code.

The accusation is that on 03.08.2016 Meena Devi came at the house of informant Pawan Sah and complained about plucking of Guava from her 'Bathan' by Anjali Kumari, daughter of the informant. On enquiry of informant regarding whereabouts of his daughter Anjali Kumar, Meena Devi told that she slapped Anjali then she laid on the earth. When daughter of the informant did not return about 1-3 hours, then he began to search his daughter, but no trace was found. Thereafter, informant went to the house of Meena Devi, where Meena Devi, her husband and sons were present, but they did not give any satisfactory reply regarding Anjali Kumari. The informant raised

Patna High Court Cr.Misc. No.20491 of 2017 (4) dt.01-08-2017 2/2 suspicion about kidnapping of his daughter by the accused persons named in the F.I.R.

Learned counsel for the petitioner submits that except the suspicion nothing has come in the course of investigation up till para 137 of the case diary. Moreover, similarly situated co-accused Meena Devi and Janardan Kumar have already been allowed privilege of anticipatory bail on 04.07.2017 vide Criminal Miscellaneous No. 16197 of 2017.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 147 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
