JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-448, 323, 324, 307, 380/34 of the Indian Penal Code. Petitioner is said to have given farsa blow, causing head injury to the informant. The aforesaid injury was found grievous in nature but submission on behalf of petitioner is that there was land dispute between the parties and according to prosecution case itself; the alleged occurrence took place on account of aforesaid land dispute.

The petitioner is languishing in jail custody since 0302-2016 without having any criminal antecedent. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.12703 of 2016 (2) dt.28-03-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kotwa P.S. Case No. 280 of 2014 to the satisfaction of Sri Rajeev Kumar 4th , learned Judicial Magistrate, Motihari, East Champaran.
