JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Jhajha P.S. Case No. 123 of 2019, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 506, 504 of the Indian Penal Code.

Allegation against petitioner No. 1 is that he assaulted the informant by means of knife and there is no specific allegation of assault against petitioner No.2. Submission of the learned counsel for the petitioners is that injury report shows that injuries are simple in nature which appears from impugned order also and moreover FIR itself shows that there is land dispute between the parties. Heard learned A.P.P. also.

No.57352 of 2019(2) dt.11-09-2019 2/2 In view of the above facts and circumstances, let petitioners, above named in the event of their arrest or surrender before the Court below within two weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned S.DJ.M., Jamui in connection with Jhajha P.S. Case No. 123 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
