ANJANA MISHRA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing for the State as also learned counsel for the B.S.F.C.

Petitioner Yamuna Singh apprehends arrest in connection with Mohania P.S. Case no. 149 of 2015 registered for the offences punishable under sections 420 and 409 of the Indian Penal Code.

Learned counsel for the petitioner submits that allegation of defalcating an amount of Rs.70,79,107/- has been made against the petitioner but petitioner has already pledged his properties to the tune of Rs.85,65,000/-as security with the District Manager, Bihar State Food and Civil Supplies Corporation,

Patna High Court Cr.Misc. No.27222 of 2015 (5) dt.01-10-2015 Kaimur and as such petitioner is entitled to the privilege of anticipatory bail as has been done in the case of other similarly situated millers.

Considering the aforementioned facts and circumstances of the case which have not been denied by the learned counsel for the B.S.F.C., and documents of which have been annexed as annexure-2 to the supplementary affidavit, petitioner above named, in the event of arrest or surrender in the court below within three weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 149 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
