JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Complaint Case No. 927 of 2015, registered under Sections 420, 323/34 and 506/34 of the Indian Penal Code.

The accusation is that on 10.05.2013, the O.P. No.2 purchased 527 Sq.ft of land of Plot No. 7 to the accused petitioner. Thereafter, she constructed the Pukka house over 491.3 Sq.ft. and remaining 35.7 Sq.ft of land was left vacant, but the accused petitioner under conspiracy sold 68 sq.ft of the said plot to Kanchan Devi on 18.12.2014 covering the vacant land of the informant. Learned counsel for the petitioner submits that, in fact, out of 680 Sq.ft. land of Plot No. 7, 527 Sq.ft. was sold to

Patna High Court Cr.Misc. No.13617 of 2017 (4) dt.29-08-2017 2/2 complainant-O.P. No.2 and 68 Sq.ft. of land is sold by the petitioner to Kanchan Devi. But, only to grab the remaining land of the petitioner of Plot No. 7 the complainant-O.P. No.2 has filed the present complaint with false contention.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Gaya in connection with Complaint Case No. 927 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
