JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 25(1-b) a/26/35 of the Arms Act.

Petitioner and three others were caught on the spot and Mini Gun Factory was unearthed and in huge quantity furnished fire arms and other apparatus were recovered. Petitioner carries criminal antecedent on several cases which is evident from perusal of paragraph-3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail at least at this stage and, accordingly, his prayer for bail in connection with Akbarpur P.S. Case No.214 of 2015

Patna High Court Cr.Misc. No.11841 of 2016 (2) dt.17-03-2016 2/2 pending in the court of A.C.J.M.II, Nawada stands rejected. However, if the trial of the petitioner is not concluded within six months from the date of receipt/production of a copy of this order, petitioner may renew his prayer for bail before the court below itself.
