JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This is an application for grant of anticipatory bail in connection with Buxar (Town) P.S. Case No. 699 of 2018, disclosing offence under Section 379 of the Indian Penal Code. Prosecution case is of committing commission of theft of motorcycle of the informant and the informant suspects the hands of the petitioner, as earlier also he tried to commit the theft of his motorcycle.

Submission of the learned counsel for the petitioner is that the F.I.R. has been lodged after ten days and nothing has been recovered from his possession.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing
