19-02-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in relation to Turkaulia P.S. Case No. 608/2017 registered under Sections 188, 353 of the Indian Penal Code.

Learned counsel for the petitioners submits that only allegation against these petitioners is that they had not

Patna High Court Cr.Misc. No.6835 of 2018 (2) dt.19-02-2018 performed the idol immersion within the time fixed by the administration. The allegation is that on 02.10.2017 when the informant reached at the Pandal of Puja Samiti the idol of Maa Durga was still sitting and all the members of the Puja Samiti including the president were obstructing the administration in discharging the government duty. Learned counsel for the State is present.

In the facts and circumstances considering the nature of allegations made, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkaulia P.S. Case No. 608/2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
