The Petitioner apprehends his arrest in Revilganj P.S. Case No.122 of 2017 instituted for the offence under Section(s) 341, 323, 379, 354, 504/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, VIII, Saran at Chapra.

It is alleged against this petitioner that he assaulted the son of the informant aged about ten years and when the informant enquired the reason for assaulting him then he abused her, threw her on the ground and also assaulted her with fists and slaps on her abdomen and chest. She ran towards her house along with the son, then this petitioner entered into her house and torn her blouse. Husband of the informant was at Kopa market. On

Patna High Court Cr.Misc. No.32367 of 2017 (2) dt.14-07-2017 2/2 information, he reached and then co-accused Deena Nah Singh caught hold of husband of the informant and this petitioner assaulted on his head with iron rod on account of which he received serious injury and fell down on the ground. This petitioner took away golden chain from the neck and other ornaments of the informant.

Injury report of husband of the informant and other injured have been annexed as Annexure-5 series. The Doctor after CT scan has found fracture in the right parietal bone of husband of the informant.

In this manner, there is specific allegation against this petitioner of assaulting the son of the informant as well as husband of the informant, who sustained grievous injury. In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
